Parkland Policy and Preventive Ethics - Session #1: Foundation: Informed Consent Policy Updates
Physicians of all levels as well as advance practice providers may participate in the informed consent process, with recent key exceptions for unrepresented individuals. Core tenets of informed consent including risks, benefits, and alternatives must be upheld in this process. The key professional practice gaps include awareness of Texas-specific “List A” procedures that require informed consent, key changes to state hierarchy for surrogate decision-maker, as well as the pre-procedural duties assigned to nursing staff to protect patient rights. Providers must be made aware of how the recent change to Texas hierarchy for surrogate decision-makers in patients with no family, also known as the unrepresented individual, impacts the obligation and responsibility to protect patient rights.

Target Audience
The content will be designed to capture the audience’s attention of key updates and complex ethical cases and is appropriate for all active Parkland medical staff members of Parkland Health.
Learning Objectives
- Identify the importance of decision-making capacity assessment when obtaining patient consent
- Recognize the legal hierarchy of priority for surrogate decision-making on behalf of the incapacitated patient
- Discuss the difference in implied consent in emergent procedures and two-physician authorization in non-emergent procedures for unrepresented individuals
- Describe the role of interdisciplinary team members to protect the patient’s rights to appropriate informed consent processes
